This exhibit applies to individuals located or residing in Mainland China (excluding Hong Kong, Macau and Taiwan, hereinafter referred to as “China”). Also, when the processing of individuals’ personal information by HEX Group Companies outside of China falls under the extraterritorial application of the Personal Information Protection Law of China, the provisions of this exhibit shall still apply.

When we process personal information, we shall obtain consent from the individuals and process the information in accordance with the principles of lawfulness, legitimacy, necessity and good faith. Individual consent to the Global Privacy Policy and this exhibit shall include consent for the processing of such personal information.

However, in the following circumstances, personal information may be processed by HEX Group Companies without obtaining consent from the individuals based on the Personal Information Protection Law of China:

・Where it is necessary for the conclusion or performance of a contract to which the individual is a contracting party;
・Where it is necessary for performing a statutory responsibility or obligation;
・Where it is necessary for responding to a public health emergency, or for protecting the life, health or property of a natural person in the case of an emergency;
・Where the individual’s personal information is processed within a reasonable scope to carry out any news reporting, supervision by public opinion or any other activities for public interest purposes;
・Where the personal information, which has already been disclosed by the individual or otherwise legally disclosed, is processed within a reasonable scope and in accordance with the Personal Information Protection Law of China; or
・Any other circumstances as provided by law or administrative regulation.

HEX Group Companies may transfer individuals’ personal information within the group itself and to processors (service providers) located in countries/regions outside of China to the extent described in the Global Privacy Policy, and individual consent to the policy and this exhibit shall also include consent to such transfer of personal information outside of China. Also, HEX Group Companies may take necessary measures to ensure that the activities of processing the personal information provided by individuals carried out by overseas recipients meet the standards of personal information protection provided in the Personal Information Protection Law of China.
In addition, the following personal information protection measures in China must be taken based on the purpose and method of processing the personal information, the type of personal information processed, the impact on personal rights and interests, any potential security risks, etc. to ensure the compliance of personal information processing activities with applicable laws and administrative regulations, and prevent any unauthorized access to, leakage of, tampering with or loss of personal information:

・Developing an internal management system and operating procedures;
・Managing personal information based on classification;
・Taking appropriate technical security measures such as encryption and de-identification;
・Reasonably determining the authorizations to process personal information, and conducting security education and training for employees on a regular basis;
・Developing and organizing the implementation of emergency plans for personal information security incidents; and
・Taking any other measures as required by law or administrative regulation.

HEX Group Companies ensure that individuals can exercise the following rights with respect to their personal information, unless otherwise provided by law or administrative regulation:

・Right to be informed and make decisions
Individuals have the right to be informed of and to decide on the processing of their personal information, as well as the right to restrict or deny other persons from processing it.
・Right to request access and copies
Individuals have the right to request access to or copies of their personal information. If such requests are made, HEX Group Companies shall provide access or copies in a timely manner.
・Right to transfer
If any individuals request to transfer their personal information to their designated personal information processors that meet the conditions prescribed by the national cybersecurity authority, HEX Group Companies shall provide the transfer method.
・Right to correct and complete
If any individuals discover that their personal information is incorrect or incomplete, they have the right to request personal information processors to correct or complete that information.
If any individuals request any personal information processors to correct or complete their personal information, HEX Group Companies shall confirm the information and correct or complete it in a timely manner.
・Right to delete
Individuals have the right to request HEX Group Companies to delete their personal information if (i) the purpose of processing has been achieved or is unable to be achieved, or the personal information is no longer necessary for achieving such purpose; (ii) the personal information processor ceases the provision of the product or service involved, or the retention period has expired; (iii) consent is withdrawn by the individual; (iv) the processing of personal information by the personal information processor is in violation of any law, administrative regulation or agreement; or (v) there are any other circumstances as provided by law or administrative regulation.
・Right to request explanation of the rules of processing personal information
Individuals have the right to request HEX Group Companies to explain their rules of processing personal information.
・Right to withdraw consent
Individuals have the right to withdraw their consent to the processing of their personal information carried out based on that consent.
